Estate Planning

Estate Administration

Upon one's passing, their Will may need to be filed with the Court to begin the probate process.  The executor would be appointed to carry out the terms of the estate plan as stated in the Will.  We represent and guide the executor with this process.  Usually, the creditors must be notified, debts paid, assets sold and funds distributed to the heirs.  We help and assist the executor to carry out these tasks and perform the other legal duties to finalize the estate as quickly as possible.  We have represented executors throughout Central Indiana for many years in the estate administration process and are ready to assist when needed.

Estate Planning

A common problem some people have is a lack of planning to create the necessary documents which is vital and important near the end of someone’s life. The estate planning process is the process we will walk you through to ensure your personal possessions and assets pass to your love ones in a fashion that you wish.  At Kuntz Law Firm, we recommend three important documents for this: Last Will and Testament, Advanced Directive, and Power of Attorney.  Pre-planning will ensure everything passes as you desire and helps avoid family arguments over your assets after you pass.  We encourage you to pre-plan now and not delay.  Call us today 765-457-8000 to start the planning process.

Last Will and Testament

The Last Will and Testament is a document that all individuals who own property and have assets should have. It's never too early to start planning for your future. You need the help of an experienced attorney to create a Last Will and Testament.  This document should be properly drafted to ensure that in the event of your death your property is distributed in the way that you wish.

Advanced Directive

An Advanced Directive makes your wishes known that you do not wish to be on life support in the event you will not be able to return to a meaningful life after a serious medical condition.   You may appoint a health care representative to make health care decisions for you in the event you are no longer able to communicate your health care decisions.  These are important documents that we recommend that you include in your estate plan.

Power Of Attorney

Everyone should appoint a Power of Attorney signed now before it is needed or before it becomes too late to sign. A Power of Attorney (POA) allows someone you appoint to act on your behalf if you are unable to act due to illness, age, or other reasons. Generally, a POA allows for that appointed representative to communicate with third parties on your behalf, pay your bills timely, cash income checks, and maintain your household affairs when you need them.  It may be revoked if you wish or automatically terminated after a certain period of time. Call Kuntz Law Firm today to have a Power of Attorney created for you!
